These Terms and Conditions of Use ("Terms") govern your access to and use of the MotiMax mobile application and any related websites, content, features, communications, and services we make available through it (together, the "Service"). By downloading, installing, accessing, creating an account for, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. The Service is made available through the Apple App Store and Google Play. Your use of the Service must also comply with the rules and policies of the relevant platform provider. Apps distributed through Apple and Google Play are licensed, not sold, and Apple may apply its standard end user licence framework where no custom store-specific term overrides it. 1. About Motimoon Apps The Service is operated by Motimoon Apps ("Motimoon Apps", "we", "us", or "our"). 2. What MotiMax Provides MotiMax is a motivation and inspiration app that provides curated quote content together with personalization, social, and premium features. Depending on the version of the Service, user settings, and device or platform compatibility, the Service may include features such as messaging, commenting, posting and sharing quotes, external sharing, in-app reporting tools, personalized content preferences, reminders, calendar features, profile and streak features, and visual themes, backgrounds, or illustrations. When starting or configuring the Service, users may be invited to provide onboarding selections and personalization preferences, such as interests, moods, reminder settings, language, app icon preferences, themes, and similar settings. Some of these selections may be required to configure the personalized experience offered by the Service. Where available, such settings may generally be changed later through the Service’s settings, profile, or subscription-management areas. Feature availability may vary by device type, operating system version, country, language, app version, store platform, and technical support status. You are responsible for maintaining a compatible device, internet connection, and any updates reasonably required for proper operation of the Service. We may add, remove, suspend, limit, or modify features, content categories, availability, or technical functionality at any time for business, legal, safety, operational, or product reasons. 3. Eligibility and Minors You may use the Service only if you can legally enter into a binding agreement under applicable law. MotiMax is intended only for users who are at least 16 years old, or the higher minimum age required by applicable law in their jurisdiction. By creating an account, accessing, or using the Service, you represent that you meet the applicable minimum age requirement. We do not knowingly permit persons below the applicable minimum age to create or use an account, use the Service, or provide information through MotiMax. If we reasonably believe that an account belongs to a person below the applicable minimum age, we may suspend or terminate the account and take related action, including deleting associated data, in accordance with applicable law. If you believe that a person below the applicable minimum age is using the Service, please contact us using the contact details provided in these Terms so that we can investigate and take appropriate action. 4. Permission to Use the Service Subject to these Terms, Motimoon Apps gives you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable permission to download, access, and use MotiMax for your personal, non-commercial, lawful use only. The Service is licensed, not sold. Except for the limited permission expressly granted in these Terms, all rights in and to the Service are reserved by Motimoon Apps and its licensors. You may use the Service only in accordance with these Terms, applicable law, and the rules of the relevant platform provider, including Apple App Store and Google Play requirements where applicable. You may not, except to the extent mandatory law expressly permits it despite this restriction: copy, reproduce, distribute, publicly display, publicly perform, reverse engineer, decompile, disassemble, attempt to derive source code from, modify, create derivative works from, resell, lease, lend, sublicense, scrape, data-mine, automate access to, or commercially exploit the Service or any part of it. You may not use the Service in a way that interferes with its operation, security, availability, or integrity, or in a way that bypasses, disables, or circumvents any feature, access control, usage limit, safety mechanism, or technical restriction of the Service. This permission to use the Service continues until it is suspended, revoked, or terminated under these Terms. If that happens, your right to use the Service ends immediately, except where applicable law provides otherwise. 5. Accounts, Security, and User Responsibility To create and use a MotiMax account, you must provide the core account information required by the Service, which includes a username and either an email address and password or the account information needed for Apple or Google sign-in. Other profile, personalization, and social-feature information may be optional. You must provide accurate information where required and keep your account details reasonably up to date through the features available in the Service. You are responsible for ensuring that the information you provide and the settings you choose are lawful, accurate, and appropriate for your use of the Service. You are responsible for safeguarding your login credentials, linked sign-in methods, device access, and account security, and for activity reasonably attributable to your account. You may update certain account information, such as your email address, username, or password, through the available account settings where those features are provided. You may not sell, rent, share for value, or transfer your account. You may not impersonate another person, misrepresent your identity, create misleading profile information, or use another person’s credentials or account without authorization. 6. Community Rules and Prohibited Conduct You agree to use MotiMax lawfully, responsibly, and in a way that respects other users, the Service, and applicable law. You may not use the Service to harass, bully, threaten, stalk, abuse, exploit, deceive, manipulate, impersonate, or encourage harm to others, or to facilitate scams, phishing, fraud, coercion, grooming, or other harmful or unlawful conduct. You may not post, send, upload, share, comment on, or otherwise make available any content that is illegal, fraudulent, misleading, hateful, discriminatory, sexually exploitative, violent, infringing, invasive of privacy, defamatory, confidential, or otherwise harmful. You may not send spam, mass-message users, create fake engagement, operate bots, scrape or extract data, bypass paywalls or access controls, probe vulnerabilities, introduce malware, interfere with security or performance, or attempt unauthorized access to the Service, its systems, or other users’ accounts or data. 7. User Content, Messaging, Comments, and Social Features Content that you create, upload, post, share, comment on, send, or otherwise make available through the Service (“User Content”) remains yours or your licensors’, but you are solely responsible for it and for ensuring that you have all rights, permissions, consents, and lawful bases necessary to provide it and allow its use through the Service. By making User Content available through MotiMax, you grant Motimoon Apps a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, format, adapt, display, distribute, communicate, and otherwise process that User Content only as reasonably necessary to operate, provide, secure, improve, moderate, investigate, back up, comply with law, enforce these Terms, and promote the Service. The Service may include profiles, messaging, message requests, comments, quote sharing, posts, reactions, typing indicators, blocking, reporting, visibility controls, streak-related features, and external sharing. 8. Reporting, Notices, and Appeals MotiMax may provide in-app reporting and related review tools that allow users to report content, accounts, messages, conduct, scams, misuse, unlawful content, safety concerns, or other suspected violations of these Terms or applicable law. When submitting a report, you should provide enough information for us to identify the issue, understand the concern, and assess the report, including any supporting context where relevant. 9. Quotes, Attribution, Editorial Discretion, and Rights Complaints MotiMax includes curated motivational and inspirational quotations and related editorial material. Quotes in the Service may be associated with historical figures, living persons, anonymous sources, public-domain materials, other editorially selected sources, or may be original quotes created by MotiMax. Unless expressly stated otherwise, MotiMax does not imply any sponsorship, endorsement, affiliation, or approval by any quote author, living person, historical figure, estate, publisher, rights holder, or representative. 10. Intellectual Property As between you and Motimoon Apps, the Service and all content, materials, and features made available by us or on our behalf are owned by Motimoon Apps or by third parties who have licensed or otherwise authorized relevant rights or materials to Motimoon Apps. Except as expressly permitted by these Terms, you may not copy, reproduce, modify, adapt, translate, distribute, publish, display, perform, sell, license, extract, scrape, mirror, frame, archive, reverse engineer, decompile, disassemble, attempt to derive source code, create derivative works from, commercialize, exploit, or otherwise use any part of the Service or our content without our prior written permission. 11. Visual Assets, Including AI-Generated and AI-Assisted Visuals Some backgrounds, themes, illustrations, paintings, or other visual elements available in MotiMax may be AI-generated, AI-assisted, edited, enhanced, modified, drawn from public-domain sources, or otherwise lawfully used based on our editorial assessment. 12. Third-Party Services and External Sharing MotiMax may interoperate with or enable access to third-party services, platforms, or tools, including Apple App Store, Google Play, sign-in providers, infrastructure providers, notification services, and external sharing destinations. 13. Paid Subscriptions, Billing, and Promotions MotiMax may offer optional paid subscriptions and other paid digital features together referred to as “Premium Services”. Subscriptions are billed and managed by the platform provider through which you purchase them, such as Apple or Google. You are responsible for managing your subscription through the relevant platform provider settings, including cancellation, renewal preferences, payment method, and account status. 14. EU Consumer Rights and Digital Services If you are a consumer in the European Economic Area, the United Kingdom, or another jurisdiction with mandatory consumer protections, those mandatory rights remain unaffected by these Terms. 15. Availability, Maintenance, and Changes to the Service We do not guarantee that MotiMax, or any feature, content category, social function, sharing tool, reminder, Premium Service, integration, or other part of the Service will always be available, uninterrupted, secure, current, compatible, or error-free. 16. Data Retention, Deletion, and Backups Your use of the Service may involve the storage or processing of account data, profile information, personalization settings, favorites, messages, comments, posts, shared quotes, streak-related information, calendar items, reminders, subscription-related records, reports, appeals, and other content or activity connected to your use of MotiMax. Data handling, retention, and deletion are also described in our Privacy Policy. 17. Disclaimers To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind. The Service is intended for general informational, inspirational, editorial, creative, social, and entertainment purposes only. It is not medical care, psychiatric care, psychotherapy, counselling, coaching, crisis intervention, legal advice, financial advice, investment advice, savings advice, tax advice, trading advice, or any other regulated professional service. 18. Limitation of Liability To the maximum extent permitted by applicable law, Motimoon Apps and its owner, affiliates, contractors, licensors, service providers, and representatives will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages. 19. Indemnity To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Motimoon Apps and its owner, affiliates, contractors, licensors, service providers, and representatives from and against any claims, allegations, liabilities, damages, judgments, losses, costs, and reasonable expenses arising out of or related to your use or misuse of the Service. 20. Suspension, Termination, and Inactivity We may suspend, restrict, disable, or terminate your access to all or part of the Service, remove or disable content, limit specific features, or take related action where we reasonably believe that you have violated these Terms, applicable law, or the rights of another person. 21. Governing Law and Dispute Resolution These Terms and any dispute or claim, whether contractual or non-contractual, arising out of or in connection with these Terms, the Service, or their subject matter or formation, are governed by the laws of Belgium, excluding its conflict-of-laws rules. Subject to applicable mandatory consumer law, the competent courts of Belgium shall have jurisdiction over disputes arising out of or relating to these Terms or the Service. 22. Changes to These Terms We may update these Terms from time to time for legal, regulatory, operational, security, technical, editorial, commercial, or product-related reasons. The updated version will become effective when posted or otherwise made available through the Service, unless a later effective date is stated. 23. General Provisions If any provision of these Terms is held to be invalid, unlawful, unenforceable, or ineffective, that provision shall be interpreted, limited, or, if necessary, severed to the minimum extent required, and the remaining provisions shall remain in full force and effect. These Terms, together with any documents expressly incorporated by reference, including the Privacy Policy and any store-facing purchase disclosures where applicable, constitute the entire agreement between you and Motimoon Apps regarding the Service. 24. This Privacy Policy explains how Motimoon Apps ("Motimoon Apps", "we", "us", or "our") collects, uses, shares, stores, and otherwise processes personal data when you use the MotiMax mobile application, related websites, content, features, communications, and services (together, the "Service"). It is intended to be read together with the Terms and Conditions of Use. This Policy is drafted with the GDPR and applicable Belgian law in mind. It describes what data we process, why we process it, how long we keep it, with whom we share it, and what rights you have. 1. This Policy does not govern third-party platforms, websites, app stores, or services that operate under their own privacy notices, including Apple, Google, social media platforms, or payment environments that you use outside the Service. 3. Personal Data We Collect 3.1 Data you provide directly Account and login data. When you create an account, we collect the information needed to register, identify, secure, and manage your account, such as your email address, username, and password. A username is required to create and use a MotiMax account. You may later update certain account information, such as your email address, username, or password, through the available account settings. If you choose to sign up or log in through Apple or Google, we may receive account information made available by that provider, such as your name, email address, relay email address, account identifier, or similar basic account details, depending on the provider, your settings, and the permissions granted. We use this information to authenticate you, create or connect your account, and help you access the Service. We also process account actions such as account deletion requests when you use those features. Onboarding and personalization data. During signup, onboarding, or later use of the Service, we collect the preferences and selections you provide to set up and personalize your experience in MotiMax. This may include your self-selected mood preference, selected topics of interest, preferred language, preferred app icon, preferred background theme, notification frequency, and selected country from the available options. Some of these selections are required to create or configure your personalized experience, while others are optional. We may use your selected mood and similar personalization choices to tailor the quotes, themes, and other content shown in your feed and elsewhere in the Service. Profile data. We collect profile information you choose to provide or save in the Service, such as your name, profile bio, zodiac sign, selected country, selected mood, selected topics of interest, and similar profile or personalization fields. Your username is visible to other users of the Service. If you choose to provide or enable them, your name, selected country, selected mood, and profile bio may also be visible to other users in accordance with your profile and visibility settings. Your selected topics of interest are visible to other users through the social features of MotiMax. Birthday information. You may choose to provide your date of birth as an optional profile field. If you do, we use it only for profile and personalization features and optional birthday-related features within MotiMax. Your date of birth is not displayed to or shared with other users through the app. Once your date of birth has been added to your account, it is not editable. MotiMax is intended only for users who are at least 16 years old, or the higher minimum age required by applicable law in their jurisdiction. Calendar and reminder data. We collect calendar items, reminders, and related information you create in the Service, such as birthdays, holidays, exams, anniversaries, and other personal events. Engagement and favorites data. We collect information about your interactions with quotes, authors, and features in the Service, such as quotes or authors you like, follow, save, or otherwise engage with. We use this information to let you access your liked or saved content later within your account and to personalize your quote feed within the Service. Messaging, interaction, and safety data. We collect information relating to your social interactions with other users in the Service. This includes personal messages you send or receive, message requests, whether a message request is accepted or declined, emoji reactions to messages, and related conversation activity. We may also collect and process message and interaction metadata such as message sent, delivered, and opened or seen status where those features are available, timestamps, typing indicator events, reaction events, participant identifiers, block events, and similar interaction-level records needed to operate messaging, safety, moderation, and related social features. We also process information about user safety and interaction controls, such as when you block another user. If a block is applied, the affected users may no longer be able to message each other or view each other’s posts through the Service. We may also process in-chat activity signals, such as when a user is actively typing in a conversation, so that this status can be shown to the other participant in that chat. User Content and social activity data. We collect content and information you create, upload, post, share, send, or otherwise provide through the Service, including comments, messages, community posts, quote shares, profile images, reports, appeals, feedback, and similar content. We also collect information about your use of the social features of MotiMax, including when you share your own content or another user’s shared quote within the app or to external platforms or other social media or communication services. We also collect social and community activity information connected to your use of the Service, such as your daily streak information, including which of the last seven days you were active or inactive, and your total streak count. Community posts, shared quotes, daily streak visibility information, total streak count, and certain related social activity may be visible to other users through the social features of MotiMax. Communications with us. We collect the information you provide when you contact us, including support requests, complaints, dispute-related communications, feedback, and privacy-rights requests. 3.2 Data collected automatically Device and app data. We automatically collect certain technical information about the device and app you use to access MotiMax, such as your operating system, app version, device time zone, push notification token, crash reports, diagnostic data, and similar technical information needed to operate, maintain, secure, and improve the Service. Identifiers, connectivity, and technical data. We may automatically collect technical and network-related information such as timestamps, connectivity status, device and app identifiers, technical tokens, and similar data reasonably necessary to operate, secure, troubleshoot, and analyze the Service. This may also include information about whether the app is active on your device or other related technical status where relevant to Service functionality. Authentication and account-security data. We may automatically collect information relating to account access, verification, credential recovery, account updates, and similar authentication or security events in order to operate the Service, protect accounts, prevent abuse, verify subscriptions or entitlements, and troubleshoot issues. Social interaction and relationship data. We may automatically collect information about how you interact with other users through the social features of MotiMax, such as messaging, replies, blocking, reporting, deleting, or similar interaction events, together with related timestamps, and moderation-related metadata reasonably needed to operate messaging, social, and safety features. Usage and activity data. We may automatically collect information about how you use the Service and its features, including interactions with quotes, authors, posts, messages, reminders, profile settings, personalization features, external sharing features, feedback tools, waitlists, calendar features, and similar product functions, together with related timestamps and usage metrics. We may use this information to provide functionality, personalize the Service, analyze engagement, improve features, and support safety, moderation, and product operations. App availability and sharing capability data. We may automatically detect whether certain third-party apps or sharing destinations are available on your device where reasonably necessary to enable sharing features and related functionality in MotiMax. This may include social media or messaging apps such as Instagram, TikTok, Facebook, Messenger, WhatsApp. We use this information to support user-requested sharing flows and related product functionality. Subscription and entitlement data. We may automatically collect limited information relating to your subscription or account-entitlement status, such as your subscription type, entitlement status, subscription validity period, and related records needed to operate Premium Services and associated account features. Notification and presence data. We may process information about notifications and in-app activity, such as notification preferences, push notification tokens, notification delivery-related information, and active presence within app features where relevant to functionality, engagement, or service operations. Profile image. When you upload a profile picture, we collect and process the image and related technical information to provide the profile image feature, store and display the image, operate the Service securely, and help detect or prevent inappropriate, unsafe, or policy-violating content. We may use trusted service providers, such as image moderation to assist with this processing. Time zone and local time data. We collect time zone and local time information from your device settings or related technical signals in order to support reminders, notifications, localization, and other time-sensitive features. 3.3 Data from other sources App stores. App stores such as Apple and Google may provide us with limited subscription, transaction, receipt, entitlement, purchase-token, or similar account-status information needed to verify purchases, manage Premium Services, and support subscription-related features. Other users. We may receive information about you from other users where they interact with you or about you through the Service, for example by sending you a message or quote, mentioning you in a comment, replying to your content, or submitting reports, complaints, appeals, or other communications relating to your content, account, or conduct. Service providers. We use service providers to support the operation of MotiMax, such as our backend, database, hosting, and infrastructure providers. These providers may process technical, storage, security, and diagnostic information on our behalf where needed to operate, maintain, and protect the Service. 3.4 Permissions We access device features and system capabilities only when reasonably needed to provide the Service and, where required, when you grant permission through your device or operating system settings. Notifications and related settings. We may request permission to send push notifications and use related device notification features so that we can deliver reminders, quote notifications, chat and thread messages, event reminders, streak notifications, service notices, moderation notices, security alerts, and similar communications. On supported devices, we may also use background notification where reasonably necessary to support timely delivery of notifications and reminders. Photos and media access. We may request access to your photo library or similar media features where needed for user-requested functionality for selecting a profile image. External sharing integrations. Where supported by your device and operating system, MotiMax may interact with third-party apps or platform integrations for sharing content, such as social media or messaging apps you choose to use. These interactions are initiated by your actions and remain subject to the settings, permissions, and privacy practices of those third-party apps or services. You can usually manage or revoke device permissions at any time through your device or operating system settings, although some features of the Service may then no longer function properly. 4. How We Use Personal Data We use personal data for the following purposes: To create, authenticate, secure, and manage accounts. We use personal data to register users, authenticate sign-in, manage linked sign-in methods such as Apple or Google, support account settings, and enable account recovery, and account deletion functions. To provide, operate, and maintain MotiMax. We use personal data to provide and operate the Service and its features, including profiles, quote feeds, personalization, favorites, messaging, comments, community posts, quote sharing, calendar features, reminders, streak features, Premium Services, and related account functions. To personalize the Service. We use onboarding, profile, preference, engagement, and activity data to tailor quote feeds, authors, themes, reminders, and other in-app content and features based on user selections, interests, settings, and interactions. To operate social, community, and sharing features. We use personal data to enable messaging, message requests, reactions, typing indicators, profile visibility, content sharing, blocking and similar safety controls, and other social or community interactions within MotiMax and, where initiated by the user, through external sharing features. To send reminders, notifications, and service communications. We use relevant data, including notification preferences, calendar data, time zone information, and technical notification data, to send reminders, quote notifications, chat and thread notifications, event reminders, streak notifications, service notices, moderation notices, and security alerts. To process subscriptions and Premium Services. We use subscription, entitlement, receipt, transaction, and related account-status information to verify purchases, manage Premium Services, confirm entitlements, and support subscription-related account features. To maintain safety, security, and service integrity. We use personal data to protect users, the Service, and our business, including for account security, fraud prevention, abuse detection, scam prevention, moderation, troubleshooting, diagnostics, system monitoring, and the investigation and response to harmful, suspicious, or unlawful activity. To review reports, complaints, appeals, and support requests. We use personal data to review reports, complaints, appeals, feedback, and support communications, to enforce our Terms and community rules, resolve issues, respond to users, and handle disputes. To analyze, improve, and develop the Service. We use technical, usage, engagement, diagnostic, and feedback data to understand how MotiMax is used, improve performance and features, refine personalization, develop new features, and support product and business planning. To comply with legal obligations and protect legal rights. We use personal data where necessary to comply with applicable law, lawful requests, regulatory obligations, recordkeeping duties, and to establish, exercise, or defend legal claims. To support business transactions. Where permitted by applicable law, we may use or disclose relevant personal data in connection with an actual or proposed merger, acquisition, reorganization, financing, sale of assets, insolvency proceeding, or similar business transaction. 5. Legal Bases for Processing Where the GDPR applies, we rely on one or more of the following legal bases depending on the context: Performance of a contract. We process personal data where necessary to create and manage your account, provide MotiMax and its features, operate messaging and community functions, personalize the Service based on your settings and interactions, manage reminders, calendar and Premium features, and otherwise provide the Service you request. Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing before withdrawal. Legitimate interests. We process personal data where reasonably necessary for our legitimate interests, provided those interests are not overridden by your interests, fundamental rights, or freedoms. This includes maintaining security, preventing fraud, abuse, scams, and misuse, operating and moderating social features, reviewing reports and appeals, providing support, analyzing usage and performance, improving the Service, developing features, and protecting users, our rights, and our business. Legal obligation. We process personal data where necessary to comply with applicable law, lawful requests, court orders, regulatory obligations, recordkeeping duties, consumer-protection requirements, tax or accounting obligations, and other mandatory legal requirements. If we rely on legitimate interests, we aim to do so only where the processing is proportionate and does not override your interests, fundamental rights, or freedoms. 6. How Social, Community, and Messaging Features Affect Privacy MotiMax includes social, community, and messaging features that allow users to interact with each other, share content, and make certain profile or activity information visible within the Service. Because of these features, some personal data and user activity may be visible to other users depending on the feature design, your settings, and how you use the Service. What other users can see. Depending on how you use MotiMax, other users may be able to see your username, selected topics of interest, community posts, shared quotes, daily streak visibility information, and total streak count. If you choose to provide or enable them, other users may also be able to see your name, selected country, selected mood, and profile bio in accordance with your profile and visibility settings. In accepted message conversations, participants may also see each other’s username, related profile layer, typing indicators, and emoji reactions where those features are available. Community content, visibility, and discoverability. If you post, comment, or share content through community or social features, that content may be visible to other users in accordance with the relevant feature design and your actions in the Service. Content may also be surfaced through feeds, profile visits, country-based pages, global sharing surfaces, shared links, or similar social features. Profile information you choose to provide, such as your profile image, bio, selected mood, streaks, selected country, and selected topics of interest, may also be visible where the product design or your settings allow it. We do not intend mood selection as medical or diagnostic information. Messages and interaction features. MotiMax may allow users to send message requests, exchange messages after acceptance, react to messages, and see certain interaction signals such as typing indicators where those features are available. Private messages are intended for communication between users, but we may access, review, or preserve messages and related metadata when reasonably necessary for moderation, abuse investigations, fraud prevention, safety, technical troubleshooting, legal compliance, or the establishment, exercise, or defense of legal claims. Unless we expressly state otherwise in the product, private messaging features should not be assumed to be end-to-end encrypted. Blocking and safety controls. When you block another user, we may process limited information necessary to apply and maintain that block and support user safety controls. Depending on the feature design, blocked users may no longer be able to message each other or view each other’s posts through the Service. External sharing. If you choose to share quotes or other content from MotiMax to external platforms or apps such as Instagram, TikTok, Facebook, WhatsApp, Messenger, or similar services, those third parties operate under their own privacy policies and terms, and their processing is outside our control. Content shared through social or community features should not be assumed to be private, temporary, or fully controllable once shared. Depending on the feature design, shared content may be visible, searchable, quoted, copied, screenshotted, recorded, forwarded, archived, reshared, or otherwise retained by other users or third parties outside our control. Where the product design allows content to be accessed through shared links, preview cards, or similar external surfaces, limited content and metadata may also become visible outside the in-app experience. Reports, complaints, and appeals. When a user submits a report, complaint, or appeal, we may review the reported content, related messages, account identifiers, screenshots, metadata, moderation history, and related communications reasonably needed to assess the issue, protect users, enforce our rules, and respond to the matter. We do not generally disclose the identity of a reporting user to the reported user unless disclosure is necessary for fairness, dispute handling, safety, or legal compliance. Sensitive data caution. We do not ask users to disclose special categories of personal data, such as health data, religious beliefs, political opinions, sexual life or orientation, or similar sensitive information, in profiles, posts, comments, messages, reports, or other social features. If you choose to include such information, it may be processed to provide the feature you used, review reports, moderate content, protect users and the Service, comply with law, or establish, exercise, or defend legal claims. Limits of deletion and control. Changing privacy or visibility settings, deleting content, blocking another user, or deleting an account may not remove copies already retained by recipients, screenshots, caches, shared links, legal records, backups, or third-party environments outside our control. If users continue interactions outside the Service, we are not responsible for third-party environments, but information about such conduct may still be processed if it is reported back to us in connection with safety, moderation, or legal issues. 7. Whether You Must Provide Data Some personal data is required for us to provide MotiMax, while other data is optional. Required data. Certain data is necessary to create and use a MotiMax account and to operate core features of the Service. This includes a username and either an email address and password or the account information needed for Apple or Google sign-in. Some onboarding selections may also be required to configure your personalized experience. If you do not provide required data, you may not be able to create an account, access the Service, or use certain features. Optional data. Other data is optional and may be provided only if you choose to do so. This may include profile details, personalization choices, calendar entries, profile image, feedback, and other optional content or settings. If you choose not to provide optional data, some features may be limited or may not function as intended. Permissions and feature-specific data. Certain permissions, settings, or feature-related data are only needed if you choose to use the relevant feature, such as notifications, profile images, social sharing, messaging, or community features. If you do not provide or enable them, those features may be unavailable or limited. 8. Sharing and Disclosure We may share personal data only where reasonably necessary for the purposes described in this Privacy Policy, including operating MotiMax, providing requested features, protecting users and the Service, complying with law, and supporting our business operations. We may also create and use aggregated or de-identified information for analytics, product improvement, safety, and business planning, and may share such information where it no longer identifies you under applicable law. 8.1 With processors and service providers We may share personal data with service providers that help us operate, maintain, secure, and support MotiMax, such as providers of backend, database, hosting, infrastructure, storage, security, communications, diagnostics, or similar operational services. These providers process personal data on our behalf and under our instructions where they act as processors, subject to applicable contractual, confidentiality, and data-protection obligations. 8.2 With other users Other users may see personal data that you choose to make available, or that is made visible through the design of the relevant feature, when you use social, messaging, profile, commenting, posting, or sharing features within MotiMax. Depending on the feature and your settings, this may include your username, selected topics of interest, community posts, shared quotes, daily streak visibility information, total streak count, and, where you choose to provide or enable them, your name, selected country, selected mood, and profile bio. In accepted message conversations, participants may also see messages, reactions, typing indicators, and related interaction-level information where those features are available. 8.3 With platform providers and payment environments Apple and Google may independently process personal data in connection with app distribution, account authentication, billing, subscriptions, app store accounts, receipts, purchase tokens, entitlements, and device-level services. Their processing is governed by their own privacy notices and terms. We may receive limited subscription, transaction, receipt, entitlement, purchase-token, or similar account-status information from these providers where needed to verify purchases, manage Premium Services, confirm entitlements, and support subscription-related features. We generally do not receive your full payment card details from Apple or Google. 8.4 With external platforms chosen by you If you choose to share quotes or other content from MotiMax to external platforms or apps such as Instagram, TikTok, Facebook, Messenger, WhatsApp, those third parties may receive the content or other information involved in that sharing action. Their processing is governed by their own privacy policies and terms. 8.5 For legal, safety, and enforcement reasons We may disclose personal data where reasonably necessary to comply with applicable law, lawful requests, court orders, or regulatory obligations; protect the rights, safety, security, or integrity of users, the public, Motimoon Apps, or the Service; investigate fraud, abuse, scams, harassment, illegal content, security incidents, Terms violations, or other harmful or unlawful conduct; review reports, complaints, appeals, and moderation matters; or establish, exercise, or defend legal claims. 8.6 Business transfers Where permitted by applicable law, personal data may be shared or transferred in connection with an actual or proposed merger, acquisition, reorganization, financing, sale of assets, insolvency proceeding, dissolution, or similar business transaction involving all or part of our business or assets. 9. International Transfers We aim to process personal data within the European Economic Area (“EEA”) where reasonably possible. However, some service providers, platform providers, or external platforms involved in the operation of MotiMax or in user-requested sharing features may process personal data outside the EEA. Where personal data is transferred outside the EEA, we will use an appropriate transfer mechanism recognized by applicable data protection law, such as an adequacy decision, Standard Contractual Clauses, or another lawful safeguard, together with supplementary measures where required. Data Retention We keep personal data only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by applicable law. We keep personal data only while it is needed to provide MotiMax and its features, maintain your account, operate social and messaging functions, manage subscriptions, protect the Service, comply with applicable law, or establish, exercise, or defend legal claims where necessary. If you delete your account, we aim to delete your personal data from our active systems and database at the same time, unless retention of specific data is required or permitted by applicable law or is reasonably necessary for security, fraud prevention, abuse prevention, dispute handling, or legal claims. Because MotiMax includes social, messaging, and external sharing features, content or information that has already been shared with other users or external platforms may still remain in those external environments outside our control even after deletion from our own systems. 11. Security We use reasonable technical and organizational measures designed to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure, taking into account the nature of the data and the risks involved. These measures may include access controls, authentication safeguards, role-based restrictions, secure infrastructure practices, and encryption in transit, as well as measures intended to support account security, service integrity, and abuse prevention. However, no method of transmission, storage, or electronic processing is completely secure, and we cannot guarantee absolute security. If a personal data breach occurs, we will investigate it and handle any required notifications, mitigation steps, and related actions in accordance with applicable law. 12. Automated Decision-Making We may use automated systems to help operate features of MotiMax, such as personalization, feed ordering, reminders, spam detection, or moderation support. We may use these technologies for purposes such as authentication, account and session management, security, fraud and abuse prevention, feature functionality, notifications, diagnostics, service performance, and support of time-sensitive or background app features. Where applicable law requires consent for non-essential technologies or access to information stored on your device, we will request or obtain that consent through the relevant in-app or device interface before using those technologies, except where applicable law allows otherwise. Where required, we will also provide users with a way to manage or withdraw such consent. You can also manage certain device permissions and related settings through your device or operating system settings, although some features of MotiMax may then be unavailable or may not function properly. 16.
